Known as the CAN-SPAM Act, the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 takes effect on January 1. The law prohibits the use of false header information in bulk commercial e-mail and requires unsolicited messages to include opt-out instructions. Penalties for violations include fines of up to $250 per e-mail, capped at up to $6 million.

The bill's authors, Senator Conrad Burns (R-Montana) and Senator Ron Wyden (D-Oregon), praised the legislation as a powerful tool for countering the spam onslaught cluttering in-boxes.

"Swift and aggressive enforcement will be essential, and Senator Burns and I will continue to push the Federal Trade Commission and others to use the tools this law gives them to fight against spam," Wyden says in a written statement. more>>

So spam carries a hirer penalty than drugs...... Interesting, sometimes US law scares me.

My question is who and how will enforce this? The idea of a spam bill is great! But seems unlikely to work. Its like the do-not-call list, its great except for the fact that I still get calls and if I report them there is no action taken for individual calls. If I report spam what good would it really do?

As I dig after my own post i found this:

It's a good idea but I am not sure it should carry a felony conviction.

I agree that this is a good Idea, would be nice not having to delete 40-50 spam messages each day just to find my 1 or 2 real emails. I tend to think that it will be like most US laws and there will be "little guys" getting prison time out of this while the big corporate spammers will never be touched.

Finally, there are some laws against these spammers... it's amazing how much spam you get these days.

This law might be quite good but hacking and using p2p etc is against the law too and everyone does again and again.... huh.gif

Weird, but this law might actually help.
I went from 30 spam a day to 1 in two weeks. (not bye using hotmails spamfilters)

Finally a law witch is actually good for everyone on the net.
boshcash
this law is useful for everyone , it stops shiteaters from (filtered) around , but i dont think p2p should be made illegal , comeon lots of people benefit from this (i am one of these)..

Lets hope the Dutch government will do the same.
Even my grand pa and ma got emails about penis enlargement blink.gif

I saved my reservations on this topic to see how it would decrease spam in my mail accounts. At least give it a chance. It has been a little over a week now and still no end to the spam. In fact spam in my email has just about doubled over the last week. mad.gif So as it seems this CAN-SPAM Act has done nothing as it stands now as it has not been enforced as of yet to throw it out there that they are serious on the spam issue.

These "smart filters" are not very smart at all.

hmmm so spammers only take maybe a few seconds out of your day to click the little tabs and click delete (more excercise than most actually do in a day) so there a mere annoyance, and since when is a mere anoyance penalized more than actual detremental full blown crimminals? I mean I too get spam but it makes me feel better that someone actually takes the time to put my addy on their mailing list. Instead of penalizing spammers why dont we make a game out of seeing how fast you can pick out the spam from the legit mail and delete it all.

My current 1 full day spam deletion time 10.4 seconds

well remember spam is different than when companies sell your information.

Well, spammers dont actually sit there and lovingly type out your e-mail address, thinking about how much they would actually like to get to know the real person behind the address, and asking themselves whether that person would actually benifit from the crap they are about to send.

So unfortunatly, I cant share in that "feel-good" factor that you might get! biggrin.gif

However, seeing as you have a warning point from posting advertising on these boards before...I can see how you might not have a problem with this!
